Welcome to AgriTok. These Terms of Use constitute a binding legal agreement between you and AgriTok. (“AgriTok,” “we,” “us,” or “our”) concerning your use of the AgriTok website and mobile app (collectively, the “Services”). By accessing or using AgriTok (our website, app, or related features), you confirm that you have read and understood these terms and agree to be bound by them. If you do not agree to all of these terms, you must discontinue use immediately.
Eligibility to Use the Platform
To use AgriTok, you must meet our age and other eligibility requirements. In general, you must be old enough to form a binding contract under applicable law at least 13 years old. If you are a minor under local law (typically under 18), you must have your parent or guardian’s permission to use AgriTok. You are responsible for ensuring your use complies with local laws in your jurisdiction.
Account Creation and Responsibilities
To access certain features of AgriTok, you may need to register an account. You agree to provide true, accurate, current, and complete information when creating your account and to update such information as needed. You are responsible for maintaining the confidentiality of your password and account, and for all activities that occur under your account. AgriTok reserves the right to suspend or terminate your account at any time if you provide false or misleading information, or if you violate any provision of these Terms. You agree that AgriTok may remove, reclaim, or change your username at our sole discretion if it is inappropriate or objectionable.
Acceptable Use and Prohibited Activities
All users must comply with these Terms and applicable laws when using AgriTok. Unacceptable behavior includes (but is not limited to) activities that harm AgriTok, its users, or any third party. Examples of prohibited activities include:
- Unauthorized data collection: Using bots, scrapers, or other automated means to harvest content or data from AgriTok is prohibited.
- Spamming and commercial misuse: Sending unsolicited messages, phishing, or using AgriTok to advertise or sell goods without authorization is prohibited.
- Illegal or abusive conduct: Posting content or engaging in activities that are unlawful, harassing, defamatory, or infringe others’ rights (copyrights, trademarks, privacy, etc.) is prohibited.
- Security violations: Attempting to hack, disrupt, or bypass any security or anti-abuse features of AgriTok (such as preventing copying of content) is forbidden.
- Impersonation and false identity: Creating multiple accounts to evade restrictions, impersonating other users, or misrepresenting your affiliation is not allowed.
Violating these rules may result in immediate suspension or termination of your account and legal action if warranted.
User-Generated Content and Content Rights
AgriTok is a community-driven platform, and users submit or share their own content (posts, photos, comments, etc.). You retain all ownership rights to the content you create and submit. However, by posting content on AgriTok you grant AgriTok a non-exclusive, perpetual, irrevocable, royalty-free license to use, reproduce, modify, distribute, and display that content in connection with providing and promoting our Services. In other words, you own what you post, but you authorize AgriTok to display and use it (for example, to share your post with others, feature it in promotions, or improve our platform).
You are solely responsible for your user content. You represent and warrant that you have all necessary rights to your submitted content and that it does not infringe the rights of any third party. AgriTok has no obligation to monitor user content, but we reserve the right to remove or refuse any content that violates these Terms or our policies. We do not guarantee the accuracy, integrity, or quality of user content, and we are not responsible for any harm resulting from it (comments, advice, or misinformation shared by other users). Users should use caution and good judgment.
Intellectual Property Ownership
All content and marks on AgriTok (including the AgriTok name, logo, design, text, graphics, images, software, and other materials) are owned by Muhu Consult. We (and our licensors) own all rights, title, and interest in the platform and its content. These materials are protected by copyright, trademark, and other intellectual property laws. You may use AgriTok and its content only as expressly authorized in these Terms. No part of AgriTok or its content may be copied, reproduced, or exploited for commercial purposes without our prior written permission.
Privacy and Data Collection
Our Privacy Policy explains how we collect, use, and protect your personal data. By using AgriTok, you consent to our data collection practices as described in that policy. Agritok complies with applicable data-privacy laws. For example, under the General Data Protection Regulation (GDPR) (which applies to data of EU residents), we implement appropriate safeguards and data-subject rights, and under the California Consumer Privacy Act (CCPA), California users have rights such as knowing what personal information we collect, requesting deletion of it, and opting out of its sale. In particular, CCPA grants California residents the rights to know what data is collected, to delete personal data, and to opt out of its sale. EU users have rights such as accessing their data, correcting or deleting it, and more. We will respond to valid requests in accordance with those laws and describe your choices in our Privacy Policy. Please review our Privacy Policy for more details.
Third-Party Services and Integrations
AgriTok may include features that integrate with or link to third-party products and services (for example, links to agricultural suppliers or social media). Such third-party services are not controlled by Agritok, and we do not endorse them. Links to external sites are provided for your convenience only. The existence of a link does not imply our endorsement of the content or policies of those sites. We are not responsible for the content, accuracy, or practices of any linked service or site. If you use a third-party integration (for example, logging in via a social platform), you also consent to be bound by that third party’s terms.
Disclaimers and Limitations of Liability
No Warranties: Agritok and its services are provided on an “AS IS” and “AS AVAILABLE” basis. We expressly disclaim all warranties of any kind (express, implied, statutory, or otherwise), including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that AgriTok will always be safe, secure, or error-free. You acknowledge that your use of the platform is at your own risk.
Limitation of Liability: To the fullest extent permitted by law, neither Agritok nor its affiliates, officers, or employees will be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Agritok, even if we have been advised of the possibility of such damages. In no event shall our total liability for all claims related to the services exceed the greater of (a) the amount you paid us in the past 12 months (if any), or (b) one hundred dollars. We are not responsible for any content provided by users or third parties, and we do not guarantee the accuracy or reliability of user communications.
Termination of Access
We may suspend or terminate your access to Agritok (including your account) at any time for any reason, including if you breach these Terms or engage in prohibited behavior. Upon termination, your right to use the Services will immediately end, and you must cease all access. Agritok is not liable to you or any third party for any termination of your access to the Services. Any sections of these Terms that should survive termination (such as intellectual property, disclaimers, and dispute resolution) will remain in effect.
Changes to the Terms
Agritok reserves the right to modify or update these Terms at any time. When we change the Terms, we will update the “Last Updated” date at the top of this page. We may also notify users of significant changes via email or in-app notification. It is your responsibility to review the Terms periodically. Your continued use of Agritok after any changes become effective means you agree to those changes. If you do not agree to a change, you must stop using Agritok.
Governing Law and Dispute Resolution
These Terms and any disputes arising under them are governed by the laws of Uganda, without regard to its conflict-of-law rules. Any legal action or proceeding between Agritok and you will take place exclusively in the federal or state courts located in Uganda. You and Agritok consent to personal jurisdiction in those courts and waive any jurisdictional or venue defenses.
